Either way, the broker agent has duties and obligations to the person who hired him or her, and is subject to rigorous state licensing standards. If an agreement to purchase the property is made, it is strictly between the seller and buyer; the broker is not a party to that agreement. However, the real estate broker and sales person may owe fiduciary duties to the buyer, seller or both that the agents represent, for which they can be liable if they breach those fiduciary duties, are negligent, or commit fraud.
