Premises Liability

When a visitor or tenant is injured on another person's property, the owner of the property may be liable if it can be proved that their negligence led to the injury; this is called premises liability.

These are some common types of injuries that occur on others' property due to negligence of the owner:

  • Criminal assaults due to inadequate security, lack of lighting and lack of warning about criminal action in the area
  • Slip and fall accidents
  • Dog bites or maulings
  • Exposure to toxic or hazardous substances such as lead or mold
  • Injuries to individuals performing work on the property without workers compensation insurance


In such cases, the plaintiff must prove that the property owner did one of the following:

  • failed to maintain the property in a way that created unsafe conditions
  • knew about the hazard but did not warn visitors or tenants
  • was not careful concerning unsafe conditions that might attract children
  • took actions or neglected conditions that caused damage to a neighboring property
